Welcome to w3developing.com (the “Site”), operated by w3developing, LLC (“w3developing,” “we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your access to and use of the Site and everything on it. Please read them carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
These Terms form a binding agreement between you and w3developing, LLC. They apply to every visitor, user, and other person who accesses the Site. By using the Site you also agree to our Privacy Policy, which is incorporated into these Terms by reference. If you are using the Site on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
w3developing is a web development and digital services studio based in Sheridan, Oregon, United States. The Site showcases our work, capabilities, writing, and original music, and provides ways to inquire about our services. The Site and its content are provided for your general information and personal, non-commercial use. We may add, change, suspend, or discontinue any part of the Site at any time without notice.
Nothing on the Site constitutes an offer, guarantee, or contract for services. Any engagement for services is governed by a separate written agreement between you and w3developing.
The Site and all of its contents are the property of w3developing, LLC, its owner Jason R. Wydro, and/or its licensors, and are protected by United States and international copyright, trademark, and other intellectual-property laws. This includes, without limitation:

Original music on the Site is written, composed, and produced by Jason R. Wydro, performing and releasing as 01DW3ST, and is published by Antique Echo Publishing (ASCAP). Both the musical compositions and the sound recordings (masters) are protected works. Rights are registered with performing-rights and mechanical-licensing organizations, including ASCAP and The MLC.
Streaming previews only. Any player embedded on the Site (for example, Spotify or Apple Music) streams a short preview or clip supplied by that platform — it does not deliver a downloadable or full-length copy of any recording from us.
You may not copy, download, rip, reproduce, distribute, sell, rent, broadcast, publicly perform, remix, sample, create derivative works from, synchronize with video, or otherwise exploit any composition or sound recording without a valid license or our prior written permission and, where applicable, the permission of the relevant rights organizations. All photography, images, illustrations, and graphic assets on the Site are original works or licensed for our use and remain protected. You may not download, copy, republish, redistribute, sell, modify, crop, add to a collection or dataset, or hotlink to any image, nor remove any watermark, caption, or credit, without our prior written permission. Viewing images in your browser as part of normal use of the Site is permitted; saving or repurposing them is not.
Our articles (including “The Journal”), stories, glossary, definitions, and other written content are original works of authorship protected by copyright. You may read and share links to this content, and you may quote brief excerpts with clear attribution and a link back to the source page, consistent with fair use. You may not republish, syndicate, translate, adapt, or reproduce substantial portions of the written content, or present it as your own, without our prior written permission.
“w3developing,” the w3developing logo, “01DW3ST,” “VPF Marketing” and the VPF (Visibility, Presentation, Function) framework, and other names, logos, slogans, and product names used on the Site are trademarks or service marks of w3developing, LLC or its owner. You may not use them without our prior written permission, and you may not use them in any manner likely to cause confusion, or to disparage or discredit us. All other trademarks appearing on the Site are the property of their respective owners.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Site and its content for your own lawful, personal, non-commercial use. This license does not include any right to:

Reservation of rights. We expressly reserve all rights in the Site’s content against text and data mining and AI/ML use to the fullest extent permitted by law, including under Article 4 of the EU Directive on Copyright in the Digital Single Market (2019/790) and comparable laws. Any use of our content to train or operate AI systems without our prior written license is unauthorized and prohibited.
This applies whether content is accessed manually, through automated crawling or scraping, or through any dataset, index, cache, or intermediary. Consuming, ingesting, or reproducing the content for these purposes is a material breach of these Terms.
Parts of the Site let you submit content — for example, comments, corrections, notes, or messages through inquiry and support forms (“Submissions”). You are solely responsible for your Submissions and represent that you own or have the right to submit them and that they do not infringe any third-party rights or violate any law.
By making a Submission, you grant w3developing a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, edit, moderate, publish, display, and remove that Submission in connection with operating and promoting the Site. Comments and corrections are moderated; we may edit, decline to publish, or remove any Submission at our sole discretion and are under no obligation to publish or retain anything. You agree not to submit content that is unlawful, defamatory, harassing, hateful, obscene, deceptive, infringing, or that contains malware, spam, or others’ personal information.
The Site may link to, or embed content from, third-party services such as Spotify, Apple Music, YouTube, and others. We do not control and are not responsible for third-party sites, services, or content, and a link or embed is not an endorsement. Your use of any third-party service is governed by that service’s own terms and privacy policy.
We respect the intellectual-property rights of others. If you believe content on the Site infringes your copyright, please send a notice to jason@w3developing.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material you claim is infringing and its location on the Site; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf. We will respond to valid notices as required by applicable law.
The Site and all content are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any information on the Site is accurate, complete, or current. Any reliance you place on the Site is at your own risk. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
To the fullest extent permitted by law, w3developing, LLC, its owner, and its affiliates, and their respective officers, employees, contractors, and licensors, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Site or its content, even if we have been advised of the possibility of such damages. Our total liability for all claims relating to the Site will not exceed one hundred U.S. dollars (US $100.00). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify, defend, and hold harmless w3developing, LLC, its owner, and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your Submissions, or your breach of these Terms or of any law or third-party right.
Your use of the Site is also governed by our Privacy Policy, which explains what information we collect and how we use it. By using the Site, you consent to the practices described in the Privacy Policy.
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute that is not subject to arbitration or small-claims court will be the state and federal courts located in Oregon, and you consent to their personal jurisdiction. Any claim must be brought within one year after it arises.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes may be highlighted on the Site. Your continued use of the Site after changes take effect constitutes your acceptance of the updated Terms.
These Terms, together with the Privacy Policy, are the entire agreement between you and w3developing regarding the Site and supersede any prior agreements on that subject. If any provision is found unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be modified to the minimum extent necessary.
